Terms & Conditions
By signing the proposal herein and placing the order with AssuranceHR, you agree that you have read the attached terms and conditions, along with the disclaimer and agree to be bound by them.
Account Keeping Fee
If an account is not paid within 28 days an Account Keeping Fee will be charged at the rate of three percent (3.0%) from the date that any payment owing to AssuranceHR falls due until such time as the amount due is paid in full. The Account Keeping Fee may be capitalised.
Adjustment of Pricing
The cost of the services may increase from time to time. Should such increase be made, AssuranceHR will notify the customer in advance.
Commissions or referral fees may be paid to AssuranceHR or its representatives by third parties when you are referred to those parties. This includes and is not limited to, enableHR, Deputy, Insurance & HR Assured.
All reasonable costs, expenses and disbursements incurred by AssuranceHR (including debt recovery costs, legal costs and agency fees) arising from or incidental to AssuranceHR exercising a right under these Terms and Conditions or from a Default Event are payable by you on demand.
A Default Event occurs if the customer fails to pay any monies owing after the date required for payment or the customer otherwise breaches the Terms and Conditions contained herein. In the event that the customer fails to make payments when they fall due, AssuranceHR may terminate this agreement in writing and terminate the customer’s access to the enableHR program.
Event Cancellation Policy
In the event that AssuranceHR for any reason whatsoever cannot make a scheduled event, AssuranceHR will offer the attendees the option of a rescheduled event or a refund.
Event Refund Policy
We offer a full refund for cancellations over 45 business days prior to an event. For cancellations between 45 and 30 business days prior to the event, we will refund 50% of the amount received from the Customer. Cancellations made less than 30 business days prior to the event are not refundable.
The laws of Tasmania govern this agreement. By signing this agreement, you consent to the exclusive jurisdiction of the Courts of Tasmania and the Commonwealth of Australia.
Limitation of Liability
AssuranceHR does not warrant that the products or services it provides, including but not limited to the Documentation, Software and HR System, are fit for their intended use and purpose. The customer must make their own checks to ensure that the products or services offered by AssuranceHR meet their requirements and needs. AssuranceHR provides the enableHR package with current legislative changes as at the time the package is provided to the customer. If the customer changes any of the templates, they do so at their own risk and should obtain their own independent legal advice to ensure that they meet legislative requirements. AssuranceHR will not be liable for any changes made by the customer. AssuranceHR is not liable for any direct or indirect loss or damages which may arise out of or consequential to the HR System. You agree to keep AssuranceHR indemnified against all liabilities, costs and expenses arising out of any claim you may bring in relation to these products or services. Under circumstances where liability cannot be excluded, such liability is limited to the value of the products or services purchased from AssuranceHR. AssuranceHR does not accept liability in any contract, tort or otherwise for any injury, damage, loss (including consequential loss), delay, additional expense or inconvenience caused directly or indirectly by force majeure or any other event which is beyond AssuranceHR ‘s control and is not preventable by reasonable diligence on AssuranceHR’s part or your part.
Whilst working with AssuranceHR, AssuranceHR will provide access to AssuranceHR’s HR intellectual property that has been carefully designed to suit your business requirements. This protected information means that you have access to a process that is highly valued in the market.
Diagnostic reports and documentation provided to you carrying the Assurance HR Management copyright, its partners copyright, HR Assured and/or enableHR copyright may be used in the management of your business only. They are not to be distributed, copied or reconstructed for any other purpose, associated companies or external parties. You should not use tools in a way that it will be materially detrimental to or be inconsistent with the AssuranceHR and/or enableHR methodologies. As your enableHR provider, you permit us to use your logo on your internal paperwork, external marketing and for use in a portfolio of clients
Issue of Credit
You authorise the AssuranceHR to disclose information contained herein to a credit reporting agency and to obtain consumer and commercial information permitted by the Privacy Act from a credit reporting agency and to use such Information in order to assess this application for credit.
Subject to provision of the Privacy Act, the applicant (and other parties named in this application) authorises AssuranceHR to seek and obtain information from other credit providers for approving this application or managing this account. These authorities shall remain in force for the duration of the credit contract.
One off invoices will be charged at the completion of the job and due for payment 7 days from invoice, except in the case of
Event confirmation – 50% deposit payable in advance and full payment is required 7 days prior to the event.
Monthly payments – will be invoiced in advance with the first payment due prior to the product or services commencing,
with even monthly payments billed on the nineteenth (19th) of the month for a minimum term of 12 months
Recruitment – 50% deposit payable in advance and 50% upon completion
Security – 60% deposit payable in advance and 40% upon completion
The customer has had the opportunity of seeking their own legal advice prior to the execution of this agreement and agrees to be bound by the terms and conditions contained herein.
Payment is due within (7) seven days of purchase. If any portion of the account should be overdue, then the full balance of the account will become due and payable on demand. Other than Travel & Accommodation which is due as at the date of booking.
All prices quoted do not include GST, Travel, Flights or Accommodation (where applicable). If travel, flights or accommodation are needed, they will be charged separately.
Term and Licence Fee
This agreement shall be for a minimum term of 12 months, unless specified otherwise and continue unless terminated in accordance with this agreement. Following the initial 12-month term, monthly/annual payments will continue. Should the agreement be terminated, then the balance of the term remains due and payable.
In the event that the customer wishes to terminate this agreement, they must provide a minimum of one (1) months’ notice in writing. The balance of the 12-month term, however, will remain due and payable. In the event that the agreement is terminated, AssuranceHR has the right to invoice the customer for the balance of the term remaining, and such monies are due and payable immediately. AssuranceHR has the right to invoice the customer for any work completed on or after the date of termination, including work invoiced to AssuranceHR by third parties for the customer on or after the date of termination
Travel and or Accommodation
Where travel and accommodation are required, payment for travel and accommodation is due in full at the time of booking and will be charged separately.
